Chemical Regulator Snares Noncompliant Paint Company

‘The Australian Pesticides and Veterinary Medicines Authority (APVMA) has secured the conviction of a Gold Coast paint company for selling un-registered anti-fouling paints,’ Mr Neville Matthew, spokesperson for the APVMA said today.

Resene Paints (Australia) Limited was convicted yesterday in the Southport Magistrates Court and fined $50,000 and ordered to pay reparations of $7727.91.

Resene sold four anti-fouling paint products to boat owners that not been submitted to the APVMA for assessment and potential registration.

‘The registration process is designed to ensure that only chemicals whose safety and environmental impacts have been assured are permitted onto the Australian market’, Mr Matthew said.

‘The conviction, and the amount that Resene was fined, demonstrates the seriousness of these types of offences.’

‘We will continue to ask courts to prosecute breaches of the law to ensure that human health and the environment are protected.’

This breach was detected through the APVMA’s continuous monitoring of the market.

Supplying unregistered agricultural and veterinary chemical products is an offence, punishable by significant fines - $165,000 for a company and individuals $33,000 and the APVMA has wide powers to recall, prevent supply, seize or dispose of unregistered chemicals.

Consumers can assist and can check the status of products via the APVMA website at no cost through the PUBCRIS database.
