WA company fined for supplying an unregistered product

Western Australian company, 4 Farmers Pty Ltd, was found guilty after a hearing in the Perth Magistrate's Court following a breach of the Agricultural and Veterinary Chemicals Code (the Agvet Code) for supplying the unregistered product - 4Farmers Chlorsulfuron WDG Water Dispersible Granules. The company was fined $7,000 and ordered to pay costs of $1,073.

"Chlorsulfuron WDG is a broad range selective herbicide used to control broadleaf weeds in cereals," the National Registration Authority for Agricultural and Veterinary Chemicals (NRA) Head of Surveillance and Enforcement, Stephen McDonald said. "It was not registered by the NRA at the time the incident was investigated."

"The NRA is responsible for ensuring compliance of agvet products up to and including the point of retail sale and the supply of unregistered herbicides is of considerable concern.

"Registration of herbicides provides a stamp of security that the products have been scientifically evaluated to ensure they pose no unacceptable risk to human health, worker safety, the environment or trade, and work effectively.

"The need for compliance when supplying chemical products cannot, therefore, be stressed enough. The compliance role is one that Australian farmers and the community want and expect the NRA to have."

The regulation of the quality and supply of agvet chemical products in Australia occurs through the National Registration Scheme.

Within the Scheme, the NRA monitors agvet chemical products and active constituents in the marketplace to make sure that they are registered and only supplied according to the provisions of the Agricultural and Veterinary Chemicals Code.

"The NRA actively investigates alleged breaches of the Agvet Code," Mr McDonald said, "and will take offenders to court. This is the 10th successful prosecution by the NRA this year for breaches of the Code, with offences including illegal use and illegal importation of chemical products."
